Allowing Expunctions For Felony Convictions

Effective for petitions filed on or after Dec. 1, 2012, this act creates a new type of expunction. New G.S. 15A-145.5 authorizes expunction of “nonviolent” misdemeanors and felonies, defined by the offenses that are not considered to be “nonviolent.” Excluded from the “nonviolent” category is class A through class G felonies and class A1 misdemeanors, offenses that include assault as an essential element, offenses requiring registration as a sex offender, certain drug offenses and other listed offenses in new G.S. 15A-145.5(as).
